When does a trailer need brakes in Ontario?

Ontario's Highway Traffic Act requires every trailer or semi-trailer with a gross weight of 1,360 kg or more—about 3,000 lb—to have brakes adequate to stop and hold the vehicle.

HOW TO APPLY IT

Use loaded trailer weight, not a brochure shortcut

Trailer cargo, fluids and installed equipment can move a trailer across the legal brake threshold.

Gross trailer weight

The Act uses gross weight. For a trip-specific decision, actual loaded trailer weight is more useful than dry weight.

Legal minimum ≠ towing maximum

Having legally required brakes does not increase the tow vehicle's GCWR, trailer rating, payload or hitch rating.

Controller compatibility

Where electric trailer brakes are used, controller type, vehicle wiring and proper setup remain separate equipment questions.
